If you are not eligible for legal aid, you may be able to obtain financial assistance under other schemes.

The child’s return journey

In some cases, the expenses for your child’s return journey may be covered by the Danish Act on Active Social Policy (subsection (2) of section 83). Contact your local municipality for more information. Any application also has to be submitted to your local municipality.

Private household insurance

If you have a private household insurance policy (‘contents’ or ‘basic’ insurance), it may include legal expenses cover. You should therefore contact your insurance company to check whether the insurance covers expenses related to legal proceedings abroad.

Free legal aid

Free legal aid means that the State provides financial assistance to ensure the individual citizen’s access to the courts. The purpose of free legal aid is therefore to give individuals with a low income the same opportunity to conduct legal proceedings as individuals with a higher income.

The rules on free legal aid apply to custody proceedings conducted in Denmark. You can obtain further information on free legal aid from the Civil Affairs Agency (Civilstyrelsen).
